Terms and Conditions

Definitions and Interpretation

1.1 These terms and conditions are written in plain English for the convenience of customers. Please note that none of these terms and conditions are to be used as part of a formal agreement and that the ‘Business Terms and Conditions’ listed separately prevail in all cases.

Acceptance of Services:
The statement by the Customer that they are satisfied with the service they have received from GoCoe

The Company is GoCoe Travel. Its formal address is:

The company is licensed as a PSV Operator with the Department of Transport Bus Operator Licence Registration No. PF 1105920

The agreement between the Customer and GoCoe. This agreement includes price, number of passengers, dates, times, pickup and drop off points.

Conduct Regulations:
The legal regulations governing the conduct of Drivers and Passengers

The person, firm or company who agrees a contract with GoCoe. This is normally the party or group organiser

Customer’s Party:
All and any of the passengers travelling with GoCoe as part of a party or group.

Customer’s belongings:
Any item, clothing, baggage or possession owned by one of the Customer’s Party.

Dead Mileage:
The distance that the bus needs to run empty (e.g. between depot and pickup/ drop off points) and the additional costs to GoCoe of running the bus empty over that distance.

The person hired or employed by GoCoe drive the bus.

A firm statement of costs for the services required.

Statement of Requirements:
What the Customer requires and what GoCoe can provide.

The hire of the minibus, bus or coach, with a Driver, taking the Customer’s Party where they wish to go.

value added tax

The bus be supplied by GoCoe.

Zero Rating: That proportion of VAT for services that are rated at zero percent (0%)

1.2 Main headings do not affect the contract

1.3 Reference to a single item means the same for many items of the same thing.

1.4 A reference to a statute or statutory provision means any written law complete with any updates

1.5 A reference to ‘writing’ or ‘written’ also includes faxes and e-mail.

1.6 Certain words and terms (e.g. include(s), including, in particular, other, otherwise) are used as they would be in everyday language and not as they would be in a legal document.

1.7 If the Contract forbids something being done, please do not encourage others to do this on your behalf.

Application of Conditions

2.1 These Conditions shall:

(a) Form part of this contract

(b) Replace any other conditions that may be inconsistent in any other documents that may have been agreed between the Customer and GoCoe

2.2 Once a Quotation has been accepted by a Customer, the Customer is committed to buying those services offered by GoCoe, subject to cancellation conditions. An offer made by a Customer is considered accepted and part of a contract if GoCoe either:

a) issue a formal acceptance of the offer

b) start or fulfill services

2.3 No Contract can be made until GoCoe issue a Quotation.

Provision of Services

3.1 The route chosen is up to GoCoe and the Driver unless agreed beforehand with the Customer. If a longer route than required is made due to road, traffic or weather conditions no discount shall be forthcoming.

3.2 For safety reasons certain items may not be carried on the vehicle. Please discuss with us if you have any queries. The Driver can refuse to take a large quantity of luggage or specific items.

3.3 GoCoe will take utmost care of your luggage and possessions, and will attempt to rectify any issues that arise. Ultimately, however, GoCoe cannot be held responsible for any loss or damage to your luggage or possessions and the Customer should ensure that personal travel insurance covers any mishaps.

3.4 For insurance and safety reasons GoCoe cannot take more passengers than the number stated on the Vehicle and the Customer should ensure that the number in their party can all be accommodated. Any increase in numbers above the Vehicle’s capacity can normally be accommodated by prior arrangement, however a new quotation and contract may need to be reissued.

3.5 The Customer must ensure that:

(a) all passengers in their party are properly behaved at all times. The Driver may refuse to allow a passenger on or insist that they leave the Vehicle if he considers them to be drunk, having taken drugs, is disorderly or could jeoparise the safety of either the vehicle, its contents or any other passengers.

(b) No passengers are to smoke or drink alcohol in the Vehicle.

(c) All passengers must follow all instructions issued by the Driver;

(d) No signs or notices are to be displayed in or on the Vehicle

(e) No animals except guide dogs and hearing dogs will be allowed. and

(f) Seat belts must be used at all times.

3.6 The Company reserves the right to charge the Customer for any special repairs or cleaning if any passenger soils or damages any part of the vehicle, especially seat fabric and fittings as a result of drink or drugs.

3.7 The Customer is responsible for the conduct of the Customer’s Party aboard the vehicle.

3.8 The time that a Driver is allowed to drive without a break and the times and duration of the break are governed by law. GoCoe cannot be held responsible for losses, delays or not completing the journey if it would involve breaking these driving laws. Losses or delays are unlikely unless caused by a passenger’s lateness, road accidents, adverse weather or diversions. The Customer’s Party will be fully updated by the driver concerning the reason for the delay and what options are available. In exceptional circumstances an unscheduled stop of up to 45 minutes may be required, or the service terminated until a relief driver joins the service.

3.9 GoCoe reserves the right to send larger vehicles i.e. vehicles with seating capacity greater than the number of passengers in the Customer’s Party.

Charges Payable upon Cancellation

1.1 If the Customer cancels the Contract before the Services begin, then the following charges apply:

1.2 Cancellation with more than five days’ notice:

A refund is due, less any deposit paid and less any charges or deposits already paid or due by GoCoe to their suppliers e.g. ferries, tolls, hotels other operator’s cancellation fees, etc.

1.3 Cancellation with less than five days’ notice:

The full payment for the Services is due.

The Company’s Obligations

5.1 The Company shall make every effort to keep to agreed times.

5.2 The Company is responsible for the conduct of the Driver under the Conduct Regulations.

5.3 GoCoe cannot be responsible for traffic congestion, road accidents, vehicle breakdown, adverse weather conditions or other matters which may:

(a) cause delays;

(b) cause a passenger to miss travel connections or appointments; or

(c) cause a passenger to lose business, profits or related costs and expenses.

5.4 If a journey cannot be completed due to circumstances beyond GoCoe’s control (e.g. accident, adverse weather etc) a partial refund will be due to the Customer.

5.5 If a journey cannot be started or completed due to circumstances within GoCoe’s control (e.g. vehicle breakdown, operational conflict or overbooking, driver sickness) full refund will be due to the Customer.

5.6 If a journey cannot be completed due to circumstances within the Customer’s control (e.g. passenger lateness, wrong venue, willful damage), no refund will be due to the Customer.

Change to the Services

1.1 For legal reasons, GoCoe may need to make changes to their Services. These will not affect the Services agreed with the Customer or the accepted Quotation.

Charges and Payment

7.1 GoCoe’s price for the Services shall be as set in the Contract according to current tariff and standard charges.

7.2 GoCoe’s current tariff of standard charges can be found on its website.

7.3 All charges quoted to the Customer shall be exclusive of VAT, however for passenger travel Services only, VAT is Zero Rated.

7.4 GoCoe shall be entitled to increase the price for the Services if the requirement or Contract is changed by the Customer.

7.5 The Customer cannot withhold payment unless they are legally entitled to do so.

7.6 If the Customer fails to pay on the due date, GoCoe reserves the right to:

(a) Charge interest on the payment until it is paid. and

(b) Suspend all Services until payment is made in full.

Limitation of Liability

8.1 Condition 8 sets out the entire financial liability of the Company (including any liability for the acts or omissions of its employees, agents and sub-contractors) to the Customer in respect of:

(a) any breach of the Contract;

(b) any use made by the Customer of the Services or any part of them; and

(c) any representation, statement or tortious act or omission (including negligence) arising under or in connection with the Contract; and should be read in conjunction with Condition 5.

8.2 All warranties and other terms implied common law are, where legally allowable, excluded from the Contract.

8.3 Nothing excludes the liability of the Company for:

(a) death or personal injury resulting from negligence; or

(b) any issues incurred by the Customer as a result of fraud or fraudulent.

8.4 Subject to Condition 8.2 and Condition 8.3

(a) the Company shall not be liable for:

(i) loss of profits;

(ii) loss of business;

(iii) loss of goodwill

(iv) loss of anticipated savings;

(v) loss of goods;

(vi) loss of contract;

(vii) loss of use;

(viii) loss of or corruption of data or information;

(ix) any other economic costs, charges or expenses.

(b) the Company’s total liability as far as the contract for the Services offered, is limited to the price paid for the Services.

Data Protection

1.1 The Customer’s name, address and payment record may be submitted to a credit reference agency, and personal data will be processed by and on behalf of the Company in connection with the Services.

Force Majeure

1.2 Subject to Condition 5, the GoCoe is not liable for issues arising regarding events beyond its control including strikes, failure of a transport network, act of God (including fire, flood, storm), riot, accident, or other unforeseen circumstance.


1.3 Subject to Condition 6, any alteration to the Contract must be agreed with GoCoe in writing.


12.1 Any rights that are agreed not to be enforced (waived) in the Contract are only effective if they are in writing with reasons given.

12.2 Waived rights do not exclude rights provided by law.


13.1 If any part of the Contract is found by a court to be invalid, the remaining parts of the contract still remain in force.

13.2 If any part of the contract would be valid if some part of it were deleted, that part will still apply even after modification.

13.3 If any part of the Contract is found by a court to be invalid any conditions referred to will not be enforceable until the contract has been altered accordingly.

Status of Pre-contractual Statements

14.1 The Contract does not rely on any promise made by any person other than as stated in the Contract.

14.2 Any information on the Company’s website or leaflets only gives an approximate idea of the services available from the Company and does not form part of a Contract.


15.1 The Customer shall not reassign any of their rights or obligations to anyone else.

15.2 However GoCoe may need to subcontract certain obligations as part of the contract.

No Partnership or agency

1.1 The Contract does not create a partnership between the Customer and GoCoe and the Customer must not act on behalf of GoCoe in any way.

Rights of Third Parties

1.2 The Contract is not applicable to anyone else other than those detailed in the Contract.

Status of the Customer

1.3 These Conditions will not affect your rights as a consumer.


1.1 Notice of cancellation or alteration to the Contract will be given in writing and sent by GoCoe to the Customer, to the address, fax or email, given in the Contract. Any issues will require proof that the revised Contract was sent by GoCoe.

Governing Law and Jurisdiction

20.1 The Contract is governed in accordance with the law of England and Wales.

20.2 The Custoemr and GoCoe agree that the courts of England and Wales shall settle any dispute or claim that arises.
